1. Agreement to These Terms
By purchasing from or accessing Bloom & Pixel Studio, you agree to be bound by these Terms of Service. If you do not agree, do not make a purchase. These terms constitute a legally binding agreement between you ("Customer") and Bloom & Pixel Studio ("we," "us," "our").
2. Products — AI-Generated Digital Clipart
All images sold by Bloom & Pixel Studio are **AI-generated digital clipart**. This is clearly disclosed in every product listing.
What you receive upon purchase:
- High-resolution PNG files (2048×2048 pixels)
- Transparent backgrounds (no white box)
- Files delivered as a ZIP archive
- Instant download via Shopify's secure delivery system
What you do NOT receive:
- Physical products
- Source files (PSD, AI, SVG, EPS)
- Exclusive rights or copyright ownership
- A guarantee that images are identical to previews (AI outputs may vary slightly)
3. License Types
Your permitted use depends on the license tier purchased. Purchasing a product does not transfer copyright — it grants you a **limited, non-exclusive license** to use the files as described below.
Personal License
You MAY:
- Use the images in personal, non-commercial projects
- Print for personal use (greeting cards, scrapbooking, home décor)
- Use in digital personal projects (wallpapers, personal social media, phone cases for yourself)
- Use an unlimited number of times for personal purposes
You MAY NOT:
- Use in any project that generates income (freelance, client work, products for sale)
- Sell, redistribute, or sublicense the image files themselves
- Claim the images as your own original artwork
- Use in commercial templates or marketing materials
Commercial License
Includes everything in the Personal License, PLUS:
You MAY:
- Use in commercial projects for clients
- Use in marketing materials, social media content, business presentations
- Use in digital products you sell (eBooks, templates, printables) — provided the clipart is not the primary product being sold
- Use in unlimited commercial projects
- Use in products with up to 500,000 end impressions
You MAY NOT:
- Sell, redistribute, or sublicense the clipart files themselves as-is or repackaged
- Sell a product where the main value is the clipart (e.g., another clipart bundle)
- Use on print-on-demand merchandise for resale (requires Extended License)
- Remove or obscure any copyright notices
Extended License
Includes everything in the Commercial License, PLUS:
You MAY:
- Use in physical or digital products you create and sell (t-shirts, mugs, prints, stickers, etc.)
- Sell up to **500 units** of any single physical product featuring these images
- Use in print-on-demand products sold through platforms like Redbubble, Etsy, Amazon Merch
- Use in templates you sell to end users
You MAY NOT:
- Sell, resell, or redistribute the raw PNG/ZIP files themselves
- Use in products exceeding 500 units without purchasing an additional Extended License
- Sub-license the files to third parties
- Use in AI training datasets
All Licenses — Prohibited Uses
Regardless of license tier, the following are **always prohibited:**
- Reselling, redistributing, or gifting the original files to others
- Uploading the files to stock photo sites, clipart libraries, or sharing platforms
- Using the images to create NFTs or blockchain-based assets
- Using the images in anything illegal, defamatory, discriminatory, or obscene
- Using the images in AI model training or dataset creation
- Claiming to have created the images yourself
4. AI-Generated Content Disclosure
All clipart sold by Bloom & Pixel Studio is created using artificial intelligence image generation technology. We do not claim the images are hand-drawn or created by a human artist unless explicitly stated.
Copyright notice: Under current U.S. Copyright Office guidance, purely AI-generated images may not qualify for full copyright protection. Bloom & Pixel Studio asserts rights over these files as the party that commissioned, selected, and curated the outputs. These rights are sufficient to license the files to you and to prohibit unauthorized redistribution, enforced through these Terms of Service as a contract.
AI content similarity: AI-generated images may occasionally resemble existing artworks, logos, or characters. This is an inherent characteristic of AI technology. We make no warranty that images are entirely free from similarity to third-party works. You use AI-generated content at your own risk.
5. No Refund Policy
All sales are final. See our [Refund Policy] for full details and the limited exception for defective files.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Bloom & Pixel Studio's total liability to you for any claim shall not exceed the amount you paid for the product giving rise to the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.
- We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party intellectual property rights.
- We do not warrant that AI-generated images are free from similarity to copyrighted works. You assume all risk of use.
7. Indemnification
You agree to indemnify, defend, and hold harmless Bloom & Pixel Studio, its owner, and affiliates from and against any claims, damages, losses, costs, and expenses (including legal fees) arising out of:
- Your use of the files in violation of these Terms
- Any claim that your use of AI-generated images infringes a third party's intellectual property rights
- Your breach of any warranty or representation
- Any products or services you create using our clipart files
8. Age Restriction
You must be at least **18 years old** to make purchases from Bloom & Pixel Studio. By completing a purchase, you confirm you are 18 or older. If you are under 18, you may only use this site with the involvement and consent of a parent or guardian.
9. Digital Delivery and Download Limits
Files are delivered electronically via Shopify's secure system immediately after payment is confirmed. You have **3 download attempts** per order. If you experience technical issues downloading your files, contact us at hello@bloomandpixelstudio.com within 7 days.
We are not responsible for files you fail to save or that are deleted from your device after download.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of **Texas**, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of **Texas**.
For minor disputes, we encourage you to contact us first at hello@bloomandpixelstudio.com — most issues can be resolved quickly without legal action.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes take effect when posted on this page. Continued use of our store after changes constitutes acceptance of the new Terms. Purchases made before a change are governed by the Terms in effect at the time of purchase.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
